Terms of Service

These Terms of Service ("Terms") govern your access to and use of Unifix (the "Service"), operated by Fast and Forward Software, S.A. de C.V. ("Unifix", "we", "us"), a company organized under the laws of Mexico.
By creating an account or using the Service, you agree to these Terms on behalf of yourself and any organization you represent. If you don't agree, don't use the Service. If you're agreeing on behalf of an organization, you confirm you have the authority to bind it.
1. Definitions
- Account — the workspace tied to your organization, including its users, settings, and data.
- User — a person you authorize to access your Account.
- Content — everything you and your Users put into the Service: tickets, client and contact records, descriptions, attachments, and any other data.
- Subscription — your paid plan and its billing cycle.
2. Your Account
You're responsible for everything that happens under your Account, and for keeping your login credentials secure. You must be a human — accounts created by bots or automated methods aren't permitted.
You're responsible for your Users' compliance with these Terms, and for the Content they put into the Service. You must provide a valid email address and any other information we reasonably need to complete signup.
You may not use the Service for anything illegal, and you're responsible for complying with the laws that apply to you and to the data you store with us — including any consent you need from the people whose information you record.
3. Payment, Refunds, and Plan Changes
Paid Subscriptions are billed in advance on a recurring basis — monthly or annually, depending on the plan you choose — and renew automatically until you cancel. Prices are in US dollars unless stated otherwise at checkout. You authorize us to charge your payment method for each cycle.
If you change plans mid-cycle, we prorate the difference: you're credited for the unused portion of your current plan and charged for the remainder of the cycle on the new one. Fees are stated exclusive of taxes; we'll add any taxes we're required to collect.
If a charge fails, we may retry it and may suspend the Account until payment succeeds. We generally don't offer refunds for partial periods, but if something has clearly gone wrong on our end, email us — we'll make it right.
4. Cancellation and Termination
You can cancel at any time from your Account settings. Cancellation takes effect at the end of your current paid cycle — you keep access until then, and you won't be charged again.
When an Account is cancelled, its Content becomes inaccessible right away. We delete it from our active systems within 30 days, and from our backups within 60 days. Export your data before you cancel if you want to keep a copy.
We may suspend or terminate an Account that breaches these Terms, that puts the Service or other customers at risk, or that's used to abuse our staff. Where it's reasonable and lawful to do so, we'll tell you why.
5. Changes to the Service and Prices
We're constantly improving the Service, which means features may be added, changed, or removed over time. We won't make a change that materially degrades core functionality without good reason.
We may change our prices. If a price change affects your current plan, we'll give you at least 30 days' notice by email, and the new price takes effect on your next renewal after that notice. If you don't agree, you can cancel before it applies.
6. Uptime, Security, and Privacy
We work hard to keep the Service available and fast, but we don't offer a formal uptime guarantee. We may occasionally need to take the Service down for maintenance, and we'll try to do that with as little disruption as possible.
We take the security of your Content seriously and encrypt sensitive data at rest. Our staff won't access the Content in your Account except in a few narrow situations: when you ask us to for support, when it's necessary to diagnose or fix a technical problem, when it's needed to keep the Service secure, or when the law compels us.
How we collect and handle personal data is described in our Privacy Policy, which forms part of these Terms. If you store other people's personal data with us, you're the data controller and we act as your processor under our Data Processing Addendum.
7. Ownership of Your Content
Your Content is yours. We don't claim any ownership over it. You grant us only the limited permission we need to operate the Service for you — to store, process, back up, and display your Content so the Service works.
The Service itself — the software, design, and the Unifix name and logo — belongs to us. These Terms don't give you any right to copy, resell, reverse-engineer, or build a competing product from the Service.
If you send us feedback or suggestions, we're free to use them to improve the Service without any obligation to you. We won't claim ownership of your ideas, but we're not restricted from acting on the general improvements you propose.
8. Acceptable Use
When using the Service, you agree not to:
- break the law or infringe anyone's rights with your Content;
- store data you don't have the right to store, or that you collected without the necessary consent;
- upload malware, or try to disrupt, overload, or gain unauthorized access to the Service or its infrastructure;
- scrape, copy, or systematically extract data from the Service except through features we provide for that purpose;
- resell or provide the Service to third parties as if it were your own; or
- abuse, threaten, or harass our staff.
Verbal, written, or other abuse of any Unifix employee will result in immediate termination of your Account.
9. Disclaimers and Limitation of Liability
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties we haven't expressly made here, including implied warranties of merchantability and fitness for a particular purpose.
You're responsible for your Content and for keeping your own copies of anything important. Although we run regular backups, we're not liable for any loss or corruption of your data.
To the fullest extent permitted by law, we won't be liable for any indirect, incidental, or consequential damages — including lost profits, lost revenue, or lost data — arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the six months before the claim arose.
10. Governing Law
These Terms are governed by the laws of Mexico. You and Fast and Forward Software, S.A. de C.V. agree to submit to the exclusive jurisdiction of the competent courts of Monterrey, Nuevo León, Mexico, waiving any other jurisdiction that might apply by reason of your present or future domicile.
11. Changes to These Terms
We may update these Terms from time to time. When we do, we'll update the "Last updated" date above. If we make a material change, we'll let you know by email. Your continued use of the Service after an update means you accept the revised Terms.
